Legal notice

1. Website owner

In accordance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI), this is to inform you that the website bitacorasistemas.es belongs to:

Business activity: provision of technology services, maintenance, support, device repairs and other IT or technology services that Bitácora Sistemas, S.L. offers and is able to provide.

Hereinafter, «Bitácora Sistemas» or the «Company».

2. Purpose and users

This legal notice governs access to, browsing of and use of bitacorasistemas.es. Its use constitutes acceptance of this legal notice, without prejudice to the General Terms and Conditions of Contract, quotations, orders, contracts or specific conditions applicable to each service.

The services may be contracted by consumers, users, self-employed persons, SMEs, companies and other individuals or legal entities requiring the services offered, provided that Bitácora Sistemas confirms their feasibility, availability and acceptance.

The Company may reject requests where it cannot provide the service with appropriate technical safeguards, owing to lack of availability, incompatibility, a security risk, a previous breach, insufficient data or any other objective and legitimate reason, which will be communicated to the customer where appropriate.

3. Contracting, quotations and specific conditions

A service will not be considered fully contracted until Bitácora Sistemas has confirmed acceptance of the order, quotation, plan or request, unless expressly stated otherwise.

Before contracting, the customer will receive or have access to the relevant information applicable to the service, including, where appropriate:

  • Description, scope and limitations of the service.
  • Applicable price, taxes and expenses.
  • Payment method and schedule.
  • Duration, frequency and renewal conditions.
  • Estimated completion period, where it can be determined.
  • The customer's technical, material, access or co-operation requirements.
  • Cancellation, termination, withdrawal or amendment conditions.
  • Applicable statutory or commercial warranties.

The specific conditions of an accepted quotation, confirmed order or contracted plan will prevail over this legal notice in matters they specifically regulate.

4. Maintenance plans and renewal

Periodic maintenance, support or recurring-service plans will have the duration, frequency, price and scope specified during contracting or in their specific conditions.

Unless expressly agreed otherwise, plans will renew automatically for successive periods equivalent to the period initially contracted. Renewal will be subject to the current conditions and prices notified to the customer in accordance with applicable legislation.

There is no minimum term. The customer may request non-renewal or termination by writing to facturacion@bitacorasistemas.es, within the notice period specified in the plan's specific conditions. Where the customer is a consumer, this period will not limit any non-waivable rights granted by applicable legislation.

Termination will prevent future renewals, but will not affect amounts accrued for periods already started, services already provided, work previously authorised or commitments validly assumed, unless the law or the specific conditions provide otherwise.

Bitácora Sistemas will clearly inform customers of any material change to the price, scope or renewal conditions before it takes effect, respecting legally required rights and periods.

5. Repairs and one-off services

Device repairs, technical work, installations, diagnostics and other one-off services will be governed by the relevant quotation, work order or specific acceptance.

Unless expressly stated otherwise, a repair or one-off service does not entail contracting a maintenance plan or create an automatic renewal.

Quotations may be subject to a prior diagnosis, parts availability, technical compatibility, the condition of the equipment, access to third-party systems or circumstances identified during the work. If additional work is required or the initially estimated amount must be materially changed, Bitácora Sistemas will request the customer's acceptance before continuing.

The customer must make a backup of their data before handing over a device or authorising work. Bitácora Sistemas will not be liable for data loss resulting from previous faults, deterioration of the equipment, malicious software, third-party failures or the absence of a backup, except where liability is legally attributable to the Company.

6. Prices, taxes, invoicing and payments

Prices will be stated in euros (€). Prices for consumers are shown inclusive of taxes; quotations for companies and professionals are stated excluding VAT, expressly indicating this. The total price and any applicable taxes, expenses or charges will be disclosed before the contract is confirmed.

The prices shown on the website are indicative starting prices. The price applicable to each job is the one stated in the quotation accepted before work begins. Component and computer-configurator prices depend on the market and change frequently: they are confirmed in the quotation at the day's price. Typographical errors or omissions may be corrected without prior notice and do not bind the owner.

All payments, regardless of the method used, are subject to current tax legislation. The use of cash, bank transfer, card, Bizum or direct debit does not alter the obligation to apply, pass on, declare and document legally required taxes, including VAT where applicable.

Bitácora Sistemas will issue an invoice or proof of payment in accordance with applicable legislation. The customer must provide correct and up-to-date billing details.

Accepted payment methods may include the following, depending on the type of service, amount and specific conditions:

  • Bank transfer.
  • Credit or debit card.
  • Bizum.
  • Direct debit.
  • Cash, only where Bitácora Sistemas expressly authorises it and within the applicable legal limits.

For periodic plans, payment will be charged in accordance with the agreed billing schedule. For repairs and one-off services, an accepted quotation, deposit, full payment in advance, payment on delivery or any other method specified in the quotation or work order may be required.

Non-payment, returned direct debits, rejected charges, fraud or any payment-method issue may result in suspension of the service, non-activation of the plan or the pausing of outstanding work, without prejudice to the rights and obligations provided by law and the applicable conditions.

7. Right of withdrawal

Where the customer is a consumer and the contract is made at a distance, they will have a right of withdrawal in the cases, within the period and under the conditions established by applicable legislation, subject to legally provided exceptions.

If the consumer expressly requests that a service begin during the withdrawal period, the financial consequences provided by law may apply. If the case is legally excluded from the right of withdrawal, Bitácora Sistemas will obtain any confirmations required.

The detailed procedure and withdrawal form are set out in the General Terms and Conditions of Contract.

8. Use of the website

The user undertakes to use the website lawfully, diligently and in good faith. The following, among other conduct, is prohibited:

  • Using the Company's content, trade marks or materials without authorisation.

Nothing in this legal notice will exclude or limit liability where such exclusion or limitation is prohibited by applicable legislation.

12. Data protection, cookies and local storage

The processing of personal data is governed by the privacy policy of bitacorasistemas.es.

This website does not use its own or third-party cookies for advertising, tracking or profiling, and does not share browsing data with advertising networks. For that reason, no consent banner is displayed.

Three things that you cause when using the website are stored in your own browser, and only there: the light or dark mode preference, the contents of the shop basket and a random session identifier used to avoid counting the same visit twice. They do not identify anyone, do not leave your device except for that anonymous identifier, and are explained in detail in the privacy policy. You can delete them at any time from your browser.

13. Complaints and contact

For enquiries, incidents, billing, termination, complaints or the exercise of rights, the customer may contact:

Where the customer is a consumer, they may contact the competent consumer authorities and exercise the rights granted by applicable legislation. Bitácora Sistemas has official complaint forms available to consumers.

14. Applicable law and jurisdiction

This legal notice is governed by Spanish law.

Where the customer is a consumer or user, the competent courts and tribunals will be those determined by the applicable mandatory legislation. For relations with companies or professionals, the applicable legislation will apply and, where valid, the agreement between the parties.

15. Amendments

Bitácora Sistemas may update this legal notice due to legal, technical, operational or commercial changes. The current version will be the one published on the website with its date of update.

Amendments affecting existing contracts will be notified and applied in accordance with the applicable legislation and contractual conditions.

16. Languages

This text is available in Spanish, Catalan and English. The Catalan and English versions are provided to make it easier to understand; in the event of any discrepancy, the Spanish version will prevail, as it is the contract version.
